Terms of Service

Service territory and eligibility

Instaemployee is offered to businesses operating in Canada and the United States. By using the service, you confirm that you are at least 18 years old and have the legal authority to enter into contracts on behalf of yourself or your business.

Acceptable use

Instaemployee is licensed for lawful business purposes only. You agree not to use the service to:

  • Resell, sublicense, or rebrand the Instaemployee platform itself to third parties, except through the white-label client features included in your plan.
  • Use the AI to deceive or defraud callers in any way.
  • Violate any applicable telecom laws, including regulations governing automated calling and caller disclosure requirements.
  • Conduct spam, robocalling, or unsolicited outbound calls.
  • Collect sensitive personal data (financial, medical, government ID) through calls.
  • Engage in any illegal activity.

Account suspension and termination

We reserve the right to suspend or terminate accounts that violate these terms, without notice and without refund. Decisions are made at our sole discretion.

Billing & cancellation

Building and testing receptionists is free. You can build as many AI receptionists as you like and test each one with a short free test call before paying anything. There is no free trial — you only pay when you choose a plan to publish a receptionist and take live calls.

When you subscribe, your payment method is charged immediately for the first billing period, and your plan renews automatically — monthly or yearly, depending on the plan you choose. Prices are listed on our pricing page. We may change pricing with 30 days notice sent to your registered email.

No refunds. Because you can build and test a receptionist for free before paying, all charges are final and non-refundable — including partial billing periods, unused time, and add-ons once a billing period has begun. See our Refund Policy for details.

To cancel: go to Dashboard → Billing and click Cancel plan. You keep full access until the end of your current billing period; cancelling stops the next renewal but does not refund the current period. If you have trouble cancelling, email us at support@instaemployee.com and we will process it within one business day.

Receptionist seats, phone numbers & the 30-day commitment

Plans include a set number of active receptionists: Starter includes 1, Growth includes 3, and Scale includes 10. Each additional receptionist beyond your plan's included count is billed at $99/month, prorated for the current billing cycle.

Publishing a receptionist commits a seat for 30 days. When you publish a receptionist, Instaemployee provisions a dedicated phone number on your behalf. This phone number carries a monthly cost paid by us to our telephony provider, and that cost is non-refundable regardless of how long you keep the receptionist published. By clicking Publish, you agree that the seat you've consumed cannot be released or refunded for 30 days from the publish date.

You can swap receptionists freely during the 30-day window. If you delete a published receptionist and re-publish a new one into the same seat within 30 days, no additional charge applies. Seats only fully release after the 30-day window has passed with no replacement.

No refunds for early deletion. Deleting a published receptionist releases its phone number but does not refund the seat fee, the $99/month additional-receptionist charge, or any prorated portion thereof. This policy exists to cover the non-refundable telephony costs we incur on your behalf.

Cycle renewal. At each billing cycle renewal, your subscription is recalculated based on currently-published receptionists plus any archived within the prior 30 days. Seats that have fully aged out are released automatically and no longer billed.

Acceptable publishing behaviour

Repeatedly publishing and deleting receptionists in a pattern that suggests an attempt to avoid additional-receptionist charges ("churning") is prohibited. We reserve the right to suspend publish access for accounts that publish more than 10 receptionists in any rolling 30-day period without a clear business justification, and to recover unpaid telephony costs from such accounts.

Governing law

These Terms of Service are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Dispute resolution

Before initiating any legal action, you agree to attempt to resolve the dispute by emailing support@instaemployee.com. We will make a good-faith effort to resolve any issue within 14 days.

Liability limitations

Instaemployee is provided “as is.” Our total liability to you for any claim arising from use of the service is capped at the total monthly subscription amount you paid in the month preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
